As follows, there is a threat of declaring the \u201cgreen\u201d tariff in Ukraine unconstitutional. If the court decides in support of the constitutional petition, all RES electricity producers, including households, will be deprived of the previously established &#8220;green&#8221; tariff, will be canceled state guarantees for mandatory redemption of electricity at the &#8220;green&#8221; tariff and payments in full, violation of state guarantees provided to investors, and as a consequence &#8211; numerous lawsuits and arbitrations against Ukraine, which will increase state budget expenditures, economic unsustainability of projects and bankruptcy of renewable energy investors.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14px;\"><strong>CONSEQUENCES OF DECLARING NORMS UNCONSTITUTIONAL<\/strong><\/span><\/p>\n<ul>\n<li style=\"text-align: justify;\"><span style=\"font-size: 14px;\">Producers of electrical energy from alternative energy sources will be\u00a0deprived of the previously established \u00abgreen tariff\u00bb from the moment\u00a0the decision of the CCU enters into legal force;<\/span><\/li>\n<li style=\"text-align: justify;\"><span style=\"font-size: 14px;\">State guarantees for RE producers will be cancelled, including the\u00a0mandatory buy-back of electrical energy at the \u00abgreen\u00bb tariff and\u00a0payment in full;<\/span><\/li>\n<li style=\"text-align: justify;\"><span style=\"font-size: 14px;\">The increase in the \u00abgreen\u00bb tariff will be cancelled, the auction price\u00a0for compliance with the level of use of equipment of Ukrainian\u00a0manufacture;<\/span><\/li>\n<li style=\"text-align: justify;\"><span style=\"font-size: 14px;\">Violation of state guarantees provided to investors and, as a result,\u00a0numerous lawsuits and arbitrations against Ukraine, which will increase\u00a0State budget expenditure;<\/span><\/li>\n<li style=\"text-align: justify;\"><span style=\"font-size: 14px;\">Economic non-viability of projects and bankruptcy of renewable\u00a0energy investors can be treated as a violation of private property and\u00a0investment integrity (regulatory forfeiture) without adequate\u00a0compensation;<\/span><\/li>\n<li style=\"text-align: justify;\"><span style=\"font-size: 14px;\">Reduction in the State budget\u2019s tax revenues (during 2020, RE\u00a0producers paid about UAH 20 billion to the State budget);<\/span><\/li>\n<li style=\"text-align: justify;\"><span style=\"font-size: 14px;\">Ukraine\u2019s loss of the image of an investment-attractive country and\u00a0reliable partner of investors.\u00a0\u00a0<\/span><\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>Dear EUEA members, friends and partners!
