Dear Viktor Fedorovych!
On October 27, 2011 the President of Ukraine used his veto over the Law of Ukraine No.3692-VI On Amendments to Article 17-1 of the Law of Ukraine On Electric Power Industry Regarding Improvement of the System of Setting Tariffs for Electricity Produced from Biogas dated October 6, 2011.
In our opinion and according to findings of the leading experts in this area, the Law of Ukraine No.3692-VI On Amendments to Article 17-1 of the Law of Ukraine On Electric Power Industry Regarding Improvement of the System of Setting Tariffs for Electricity Produced from Biogas dated October 6, 2011 fully meets the interests of Ukraine, the world trends of energy development, and the conditions of the Kyoto Protocol, it promotes attraction of significant foreign investment, job creation and is one of the elements of Ukrainian laws adaptation to EU standards.
In addition, paragraphs 1, 2 and 4 of the President’s Proposals do not correspond to the world trends of renewable energy sources development, existing state programs, and instructions of the President of Ukraine.
Please note that the Renewable Energy Institute of the National Academy of Sciences of Ukraine did not provide any calculations to which you refer to in paragraph 1 of the Proposals, and the justification cited in paragraph 4 is in contrary to fact and needs clarification.
In this regard, we are asking you to recall the recommendation of the President of Ukraine dated October 27, 2011 for re-consideration of the Law of Ukraine No.3692-VI On Amendments to Article 17-1 of the Law of Ukraine On Electric Power Industry Regarding Improvement of the System of Setting Tariffs for Electricity Produced from Biogas by the Verkhovna Rada of Ukraine.
The remarks prepared by leading national experts in respect of paragraphs 1, 2 and 4 of the Proposals of the President of Ukraine dated October 27, 2011 are attached hereto on 3 sheets.
