The NEURC approved amendments to the Market Rules, which will regulate the issue of reimbursement of unsold electricity by producers selling at a “feed-in” tariff or at an auction price, in the case of the dispatcher’s command to reduce the load.
In order to implement the provisions of the Laws of Ukraine “On Electricity Market” and “On Amendments to Certain Laws of Ukraine to Improve Conditions for Supporting Electricity Production from Alternative Energy Sources” a draft resolution of the National Commission for State Regulation of Energy and Utilities “On Approval of Amendments to Market Rules” was developed.
This draft resolution provides for the definition of the mechanism of reimbursement of unreleased electricity by producers selling at a “feed-in” tariff or at auction price, in the case of the dispatcher’s team to reduce the load (reimbursement) and the method of calculating the amount of unreleased electricity by the producer selling the electricity at the “feed-in” tariff or at the auction price, as a result of execution of commands of the transmission system operator (Methodology).
In accordance with the approved changes, in particular, the following is determined:
- The amount of such reimbursement is equal to the product of the “feed-in” tariff or the auction price corresponding to such producer and the amount of unsold electricity calculated in accordance with the Methodology, which is Annex 8 to the Market Rules.
- The method determines the reference method, and in case of impossibility of its application, the calculation method.
- The calculation of the amount of compensation shall be carried out by the manufacturer or another market participant and checked by the transmission system operator.
- In case of incomplete execution of the dispatcher’s command for unloading by the producer selling at the “feed-in” tariff or at the auction price, such producer shall make payment for non-compliance with the execution of such command.
The draft resolution was approved by the Antimonopoly Committee of Ukraine and approved on the 11th of November at an open meeting of the NEURC.
