PJSC “NPC “Ukrenergo” paid UAH 454 million to SE “Guaranteed Buyer” to offset the costs of purchasing RES electricity at a “green” tariff. This is about 30% of the total estimated amount of debt for July 2019 – UAH 1.58 billion. The remaining balance will be calculated after the close of the current month.

Concerning the tariffs of Ukrenergo in August: on July 22, 2019, a new lawsuit was filed by the Nikopol Ferroalloy Plant on the recognition of the illegal of the NEURC Resolution №1411 dated July 12, 2019 on setting the tariff for Ukrenergo for electricity transmission services and tariff for services of dispatching (operational and technological) management from August 1, 2019.

On July 30, 2019, the District Administrative Court of Kyiv denied the Nikopol Ferroalloy Plant in the claim for suspension of the NEURC Resolution due to the lack of the ground to assert the illegality of the NEURC decision.

To recall the situation regarding the tariffs of Ukrenergo in July: by the resolution of the District Administrative Court of Kyiv dated June 27, 2019, the claim of Nikopol Ferroalloy Plant on the recognition of illegal and the cancellation of resolutions of the NEURC dated June 7, 2019 №954 and №955 on setting the tariff of Ukrenergo for transmission services and tariff for services of dispatching (operational and technological) management for the second half of 2019 was approved and resolutions were suspended.

Due to the suspension of the above-mentioned resolutions, Ukrenergo is unable to perform all the functions entrusted to it because of the introduction of a new model of the electricity market in July, which has a negative impact on settlements with electricity producers working at the “green” tariff system.

Ukrenergo appealed against the above-mentioned court decision immediately. On the 31th of July the Sixth Administrative Court of Appeal postponed appeal hearing. The next hearing is scheduled for August 21.
