On September 20, 2022, the European-Ukrainian Energy Agency (EUEA) together with the Ukrainian Association of Renewable Energy (UARE), the Ukrainian Wind Energy Association (UWEA), the Association of Solar Energy of Ukraine (ASEU), which unite more than 90% of the renewable electricity market of Ukraine, sent a joint letter to the Chairman of NEURC regarding the reimbursement of the Guaranteed Buyer’s share of imbalances on the part of RES producers, arising in connection with the decision of the Supreme Court of Ukraine dated 09.08.2022 in case №640/4069/21.
In order to streamline the activities of Guaranteed Buyer’s Balancing Group, ensure the legality of NEURC activities, and minimize harm to RES producers, RES representatives ask NEURC to:
- ensure the revision of the formula for calculating the cost share of the guaranteed buyer’s electricity imbalance settlement, taking into account the conclusions regarding the application of the norms of the Law of Ukraine “On the Electricity Market”, set out in the decision of the Supreme Court of Ukraine dated 09.08.2022 in case №640/4069/21;
- provide compensation for the damage suffered by RES producers as a result of the payment of the cost share of the guaranteed buyer’s electricity imbalance settlement, calculated according to the formula provided for by the resolution of the NEURC dated 15.01.2021 №46, which was recognized by the decision of the Supreme Court of Ukraine dated 08.09.2022 in case №640/4069 /21 illegal.
