On August 11, 2022, the leading RES associations in Ukraine: EUEA, UWEA, UARE, ASEU, sent a joint letter to the President of Ukraine, the Prime Minister of Ukraine, the Minister of Energy of Ukraine and the Chairman of the NEURC regarding the threat of bankruptcy of the most transparent and investment-friendly attractive RES in the energy industry of Ukraine.

The letter in English: 4 Association Letter 2022 08 11 Eng

In the letter, the Associations noted the level of settlements with the RES sector and the adopted orders (No. 140 dated 28.03.2022, No. 206 dated 15.06.2022), which artificially limited the level of payments to RES producers, as a result, the industry was on the verge of default. Moreover, since the beginning of March 2022, NPC “Ukrenergo” has not made any payment for the service of ensuring an increase in the share of electric energy production from renewable energy sources to SE “Guaranteed Buyer”.

In addition, since March 2022, state authorities have repeatedly started discussing the issue of canceling the “green” tariff under the pretext of war and shortage of funds in the electricity market.

According to publicly announced information, such negotiations are already taking place even at a high level with the Energy Community, in particular, on the part of the NEURC.
Adopting a decision to cancel the terms of contracts regarding the “green” tariff for RES producers and stop payments, even temporarily, will lead to the loss of about 8 GW of power plant capacity from RES, which in turn will worsen energy security and energy independence of Ukraine.

Taking into account the above in the letter, the RES sector calls on the state authorities to ensure the continuity of legally provided guarantees for investors in RES, to recommend to the state authorities to refrain from any retrospective changes to the current legislation, as well as to promote the elimination of the above-mentioned artificial obstacles for activities and settlements with RES producers.
