The Regulations on the Council of Experts on Energy Security have been approved
The Presidential Decree approved the Regulations on the Council of Experts on Energy Security. Oleksiy Danilov, Secretary of the National Security and Defense Council of Ukraine, has been appointed Chairman of the Council of Experts on Energy Security.
Among the main tasks of the Council of Experts on Energy Security are analysis of the state and forecasting of trends in the development of the fuel and energy sector; analysis of the regulation of fuel and energy markets; analysis of draft regulations on the functioning of the fuel and energy sector; preparation of a proposal within the competence.

The Government has approved an Economic Stimulus Program for Overcoming the Consequences of the COVID-19 Epidemic
On May 27, 2020, at a meeting of the Government, the Economic Stimulus Program for Overcoming the Consequences of the COVID-19 Epidemic was approved, subject to its completion.
The Program states that the energy sector ensures the work of all sectors of the economy. Among the measures to address the situation in the energy sector are:
– improving the regulatory framework;
– easing quarantine restrictions will allow you to resume business activity and save jobs;
– ensuring the financial stability of the system: elimination of debts between market participants; stabilization of market prices to ensure financial liquidity of all market participants; gradual revision of tariffs for the population and others.

The Report on the results of the Regulator’s activity for 2019 has been published
In 2019, NEURC set a “green” tariff for 511 electric power facilities producing electric energy from alternative energy sources. At the end of 2019, the installed capacity of electric power facilities producing electric energy from alternative energy sources tripled compared to 2018 and amounts to 6,378.6 MW.
The Report notes that the construction and commissioning in 2019 of new electric power facilities producing electric energy from alternative energy sources allowed to increase employment in the energy sector and led to an increase in the number of new jobs. As of 01.01.2020, in the energy sector, associated with the production of electricity from alternative energy sources, 7840 workers were employed.

NEURC developed and approved a draft decision “On the approval of amendments to the Market Rules”
The Regulator at its meeting of May 27, 2020, developed and approved a draft decision “On the approval of amendments to the Market Rules”.
This draft resolution provides for amendments to the Market Rules in terms of reimbursement of unsold electricity by producers selling at a “green” tariff or at auction price, in the case of the dispatcher’s team to reduce the load and the method of calculating such unsold electricity. The Regulator proposes that such compensation be provided by the transmission system operator, NPC Ukrenergo, through the balancing market mechanism.

New stages of easing the quarantine restrictions in most regions of Ukraine, the launch of the subway in Kyiv, Kharkiv, and the Dnieper have somewhat improved the situation with electricity consumption. Last week, May 25-31, the average daily consumption on working days increased by 2.1%, on weekends – by 1.8%. In general, in May 2020, consumption (according to current data) is 5.8% less than in May 2019. There were no dispatch restrictions on WPP and SPP generations.

Zaporizka TPP has become an ancillary services market participant
NPC Ukrenergo issued to Zaporizka TPP of PJSC DTEK Dniproenergo a certificate of compliance of its electrical installations with requirements for ancillary services. Zaporizka TPP has the ability to provide ancillary services of secondary and tertiary regulation.
As for now, there are 11 power plants that can participate in auctions for purchasing ancillary services, including 8 HPPs that are part of state PJSC Ukrhydroenergo, Kurakhivska TPP of PJSC DTEK Skhidenergo, Kharkivska CHP-5, and Zaporizka TPP of PJSC DTEK Dniproenergo.

In May, the Guaranteed Buyer paid only 7% for electricity, the level of payments in 2020 is 33%
On May 25, 2020, the Guaranteed Buyer made an advance payment for “green” electricity with funds received from the sale of electricity from RES in organized market segments. The company partially paid for electricity for 20 days in May. The amount of the advance payment amounted to UAH 150 million. In total, the Guaranteed Buyer paid UAH 220 million for electricity in May. The level of calculation for the current month was 7%.

About Tax Obligations of a Guaranteed Buyer
On May 23, 2020, amendments to the Tax Code of Ukraine entered into force: for the Guaranteed Buyer, the date of occurrence of tax liabilities and the tax credit is now determined by the cash method.
Prior to the amendments to the Tax Code, the service of increasing the share of electricity production from alternative energy sources was subject to VAT upon its provision. Thus, in case of non-payment by NPC Ukrenergo, the Guaranteed Buyer was not only unable to pay for electricity purchased at the “green” tariff but also fulfilled additional tax obligations to pay VAT.
